Applicability of common-law sanctions

At common law there were, of course, no consideration of crimes involving computers. With its historic flexibility, however, the common law has provided sanctions for many types of computer crime.FN7 In fact, many computer crime cases have been successfully prosecuted pursuant to state common-law provisions. Analogously, a number of widely publicized cases considered "computer crimes" have been prosecuted pursuant to federal proscriptions of interstate transportation of stolen property,FN8 theft of government property,FN9 mail and wire fraud,FN10 and embezzlement.FN11
