Illustrative form—defendant's agreement to appear

In order to be granted release on his or her own recognizance, a criminal defendant must sign an agreement to appear in court whenever instructed to do so in connection with the matter for which he or she was arrested. Below is a typical agreement entered into between the defendant and the court.

AGREEMENT TO APPEAR

I certify (or declare) under the penalty of perjury that, pursuant to the provisions of [statute], I hereby agree to the following conditions:

That I will appear on [Date] at the above-designated department of the court, located at [Address] in [City and State] and at all times and in whatever court in which the above matter may be scheduled;

That if I fail to so appear and am apprehended outside of the State of [Name], I waive extradition; and

That any court of competent jurisdiction may revoke the order of release and either return me to custody or require that I give bail or other assurance of my appearance as elsewhere provided by [Statute].
