State computer crime laws often overlap with other criminal laws covering theft, embezzlement, extortion, and malicious mischief. Computer crime laws may also overlap with theft of government property, transportation of stolen property across state lines, untrue statements to banks or credit agencies, and violations of privacy laws.FN19 Therefore, it is possible that the defendant has already been tried, in the same jurisdiction or another jurisdiction, for the acts that are alleged to constitute a computer crime.FN20 The defense attorney must determine if the earlier prosecution constitutes a bar to the current prosecution according to the rules against double jeopardy.
