Possession of hardware designed for illegal purpose

A charge of possession of burglar's tools is sustained by an allegation that the defendant was using or intended to use a blue box, an electronic device used to bypass a telephone company's billing equipment, because unlawfulness of use or intended use may be inferred from the fact that such a box has no legitimate noncriminal use or purpose. The charge fails, however, where facts fail to establish that the box was operational or that the defendant possessed the box under circumstances evincing intent to use the box in the commission of larceny.FN85
