Release on own recognizance—Questions checklist

The checklist that follows demonstrates the types of questions, which are considered in a jurisdiction's decisions about own recognizance (O.R.) release. As the checklist indicates, the questions asked by the O.R. investigator are generally not different from those that a court would consider in determining the amount of bail.

  • Community or family ties
  • Time in local area
  • Previous residence
  • Residence to return to after incarceration Employment Record
  • Length of time
  • Type of employment
  • By whom employed Criminal record
  • Arrests between year of first and year of last arrest
  • List of convictions

In addition, representatives of the police, probation, parole, and district attorney's office may offer comments about whether or not they oppose O-R release.
