Motion for change of venue—Based on publicity

A motion for a change of venue, based on extensive publicity, is usually appropriate long before trial, because cases tend to receive the greatest publicity at the time of arrest and after a jury is chosen and the trial testimony begun. In most jurisdictions, however, the motion may be made or renewed at any time for good cause.FN60

Whenever the motion is made, the considerations set forth in arguing the motion are essentially identical.FN61
