Illustrative form—Order for release on own recognizance

Once it has been determined that the accused qualifies for release on his or her own recognizance, an order from the judge must be obtained and delivered to those empowered to effect that release.

The following is a typical order of release:

ORDER RELEASING DEFENDANT

TO: The Sheriff of the County of [County Name].

It is hereby ordered that, as to the above-entitled action, [Name], the said defendant, be released from custody on his or her own recognizance.
