After the trial is over and time for appeal has expired, defense counsel may seek the release and return of any exhibits presented by the defense to the court. Court application is necessary and frequently must be made either on notice to the prosecution or with its consent.FN78 The order obtained from the court must be presented to the appropriate persons having custody of the evidence. In many jurisdictions a form is available that includes the application, consent, and order all in one, thereby saving counsel valuable time.FN79
