Summation provides the defense counsel's final opportunity to emphasize the evidence supporting the defendant's innocence. While in most criminal cases the defense summation avoids unfavorable evidence, there is the view that a weak explanation of evidence is more support for a juror who doesn't want to convict the defendant, than no explanation at all.FN61
