Minors as defense witnesses

If the defendant is very young, children may be significant defense witnesses. As a rule, these witnesses must be old enough to qualify to testify, be able to understand the nature of an oath, and know the meaning of telling the truth. More significant problems for defense counsel include preparing the witness for cross-examination, and capitalizing on any attempts by the prosecution to take advantage of the witness's inexperience in legal matters.FN59
