Likelihood of light sentencing; equities favoring defendant

Most computer crime cases that have gone to trial have resulted in a light sentence.FN74 Therefore, the prosecutor must consider what he or she stands to gain by litigating the case.FN75 To the extent that the client has lived a crime-free life, contributed to his or her community, shown unusual intelligence or ability, or otherwise distinguished himself or herself from the run of the mill, these factors should be brought to the attention of the prosecutor with the implication that they are likely to influence the court in granting a light sentence.
